Terms of Service

These terms are an agreement between you and Andrés Ballen, operating as Nostalgy (“we”, “us”), for your use of the Nostalgy.AI web app (“Nostalgy.AI”). By creating an account or using Nostalgy.AI you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Nostalgy.AI.

1. Who can use Nostalgy.AI

You must be at least 13 years old, and old enough to agree to these terms where you live. Purchases by anyone under the age of majority require a parent’s or guardian’s permission. You are responsible for keeping your login details secure and for activity on your account.

2. What Nostalgy.AI does

Nostalgy.AI uses artificial intelligence to restore, colorize and animate photos. Results are artistic reconstructions: colors, details and motion are generated by AI and may not match the original scene, people or period. Results are not suitable as historical, forensic or legal evidence.

3. Your photos and your rights

  • You keep all rights to the photos you upload and to the results we create from them.
  • You give us a limited permission to store, process and display your photos and results only to provide Nostalgy.AI to you (including sending them to our AI providers). This permission ends when you delete them or your account, except for copies our providers keep for a short time under their terms.
  • You confirm that you own each photo or have permission to use it, and that your use respects the privacy and rights of the people in it.

4. What you can’t upload or create

Don’t use Nostalgy.AI to:

  • upload or create sexual content involving minors, or any sexually explicit content;
  • create misleading images or videos of real people intended to deceive, harass, defame or impersonate them;
  • upload content that is illegal, hateful or violent, or that infringes someone else’s copyright or privacy;
  • overload, reverse-engineer or bypass the security, credit system or rate limits of Nostalgy.AI, or create accounts to abuse free credits or referrals.

We may remove content and suspend or close accounts that break these rules, and we may report illegal content to the authorities.

5. Credits and payments

  • New accounts receive free credits, and referrals can earn bonus credits.
  • Credit packs are one-time purchases, processed by Stripe. Prices are shown in US dollars before you pay.
  • One restoration uses 1 credit; one video uses the number of credits shown in the app before you generate it.
  • Credits don’t expire while your account is active and have no cash value. They can’t be transferred or exchanged for money.
  • If a video fails to generate because of a technical problem, the credits are returned to your balance automatically.
  • Refunds: purchases are final, except where required by law or where a technical problem on our side prevented you from using the credits you bought. Contact support@nostalgy.dev within 30 days of purchase and we’ll review your request.
  • We may change prices or pack sizes in the future; changes don’t affect credits you’ve already bought.

6. Our content

Nostalgy.AI, including its software, design and brand, belongs to us or our licensors. We give you a personal, non-transferable, non-exclusive license to use it. Images shared through the app may carry a “Restored by Nostalgy.AI” label; please don’t remove it from content you post publicly through those share buttons.

7. Changes and availability

We may add, change or remove features. We may update these terms; if a change is material we will notify you by email or in the app before it takes effect. Continuing to use Nostalgy.AI after that means you accept the new terms. If we discontinue the service, we will give reasonable notice so you can download your photos.

8. Ending your use

You can stop using Nostalgy.AI and delete your account at any time. Unused credits are lost when an account is deleted. We may suspend or end your access if you break these terms.

9. Disclaimers

Nostalgy.AI is provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including that results will be accurate or meet your expectations, fitness for a particular purpose and non-infringement. Please keep your own copies of original photos — don’t rely on Nostalgy.AI as your only backup.

10. Limitation of liability

To the fullest extent allowed by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Our total liability for any claim relating to Nostalgy.AI is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don’t allow these limits, so they may not apply to you.

11. Indemnity

If you upload content you don’t have the rights to, misuse Nostalgy.AI or break these terms and a claim is brought against us as a result, you agree to cover the reasonable costs and damages that result, to the extent allowed by law.

12. Governing law

These terms are governed by the laws of the United States and of the U.S. state in which the operator resides, without regard to conflict-of-law rules. If you are a consumer, you keep any protections the laws of your country of residence give you.
